MINUTES OF MEETING
JANUARY 8, 2004

PRESENT: Chairman Tracy Scott, Stan Brehm, Joanna McIntosh, Peter Wade, Mike Stamowlaros, Ron Lesieur, Dave Colbert, Fred Chagnon, Brad Towle and Secretary Andrea Deachman

Chairman Scott introduced the Board, and requested they review the minutes of December 4, 2003. Chairman Scott requested the JunkYard revision be reflected in the minutes under Zoning Changes Discussion.

Motion was made to accept the minutes with the change.

                                                Map 3, Lot 17, Dover Road

Abutters present: Margaret Barrar

Mr. Talbot presented his plan to the Board; the Board was in agreement that the following items need to be on the plan, wetlands, watercourses, soil types and location of the sign. Mr. Talbot needs to check with State Department of Transportation on the location of the parking and building. The Board requested the State Driveway permit and a letter from the owner stating this project is acceptable.

                                                Junk Yard RSA Revision

Junk Yard RSA to be changed from NH Revised Statutes, Chapter 267, section 1-4 to 236:111 through 236:129. This change is to reference the proper RSA.

Motion to accept the change.

PUBLIC HEARING:                         Subdivision/Site Review
                                                Wetlands additions

The Wetlands section of the zoning ordinance will be inserted in the Subdivision Regulations at P and the Site Review Regulations at J.

Motion was made to accept the inclusions of the wetlands section of the Zoning in the Subdivision and Site Review Regulations.

                                                Junk Yard RSA Revision

Junk Yard RSA to be changed from NH Revised Statutes, Chapter 267, section 1-4 to 236:111 through 236:129. This change is to reference the proper RSA.

Motion to accept the change and place the item on the ballot for public vote in March.

Changes that were made: All reference to Article has been changed to Ordinance. Under 3, Regulations, C.  Sentence 2 …not to exceed change 20 to 25 feet and end the sentence. Remove the rest of that section. Under D.  after …flush with the ceiling of the canopy add, and is fully shielded and remove rest of sentence.  Under 5. Last line remove…be either re directed or fully shielded… add …fully comply with this ordinance…

There were minor typographical errors that will also be fixed.

PUBLIC HEARING:                 Zoning Changes/Additions
                                        62 and older Housing

Page one first paragraph last line remove as a special exception. Under Description of Elderly Housing District, remove heading Special Exception Conditions, change the paragraph to read: Any site proposed for elderly housing under this section shall be allowed through the site review process and if the Planning Board finds that all of the following conditions are met the project may be approved at Public Hearing. Page 2, C. add all permit approvals must be in place prior to site review. F. change # 2 to read: 2) Fire detection systems and Fire Suppression systems shall meet National Fire Protection Association (NFPA) guidelines. Remove 3). I. Minimum lot frontage shall be 300 feet. Page 3, J. add and 35 feet between each building.

Changes that were made: Page 3 under Permitted Uses, j. change to Multi-use, Page 3 # 5, Delete New Hampshire Water Supply and Pollution Control Commission and add Department of Environmental Services. Page 4, #12 add, complying with lighting ordinance.

Zoning Violation Penalty

All penalties to be raised to $100.00 per day as in the Subdivision and Site Review Regulations.

Was voted on and accepted, to be put on town ballot in March.

DESIGN REVIEW:                  Mike Sargent
                                        Subdivision
                                        Map 8, Lot 50, Suncook Valley Road

Abutters present: Robert & Faye McAnney

Mr. Sargent presented plans to the Board a few concerns were soil types and signature block. Mr. Sargent requested a letter of intent for approval for the proposed layout, because DOT will not discuss his highway entrance until they have something in writing from the Planning Board, letter to be sent.

DISCUSSION:                     Chris & Tina Drew
                                        Home Occupation – Dog Boarding
                                        Map 1, Lot 489A, Lane Road

Mr. & Mrs. Drew would like to board 2 to 3 dogs in their house overnight and would like their approved Home occupation to include this addition.

DISCUSSION:                     Mark Blasko – Luke & Elaine Smith Property
                                        New Business
                                        Map 2, Lot 87A, Dover Road

Mr. Blasko presented the Board with a rough drawing of the property and proposed site for the new building, parking and roadway. Because of the wetlands ordinance setback requirements, the Board is in agreement to deny this proposal. A letter of denial to be sent to Mr. Blasko.


DISCUSSION:                     Kevin Kennedy – Lloyd Kendall Property
                                        New Business/Change of Use – CPA Office
                                        Map 3, Lot 15, Dover Road

Mr. Kennedy would like to change the use of this property to a CPA office, the Board was in agreement that this fit into the proposed ‘Village District’ and told Mr. Kennedy that he would need to go through the Site Review process.

Design Review/Public Hearing set for February 5, 2004 unless Mr. Kennedy calls to cancel.
